TERMS & CONDITIONS

About The Bottled Garden

1. Supplier identity and contact

THE BOTTLED GARDEN (PTY) LTD (registration 2026/787285/07) is a private company registered in South Africa and trading as The Bottled Garden. Director: Michaela Visser. Registered office, physical address and address for service: 10 Pigeonwood Close, Glen Anil, Durban North, KwaZulu-Natal, 4051, South Africa. Website: https://thebottledgarden.co.za. Email: info@thebottledgarden.co.za. Telephone/WhatsApp: +27 72 184 1906. Visits and collections by prior appointment only. We are not currently VAT registered; Transactions entered into before the company became the contracting supplier retain the original contracting party unless lawfully transferred.

2. Scope, interpretation and consumer rights

These terms apply to purchases of plants, terrariums, kits, accessories, custom commissions, delivery, collection, workshops and private events where THE BOTTLED GARDEN (PTY) LTD is the supplier. Product descriptions, accepted quotations and event booking confirmations specify the transaction. Where a specific term conflicts with mandatory South African law, that law prevails. No clause removes rights under the Consumer Protection Act (CPA), Electronic Communications and Transactions Act (ECTA) or other applicable law. Updated terms apply prospectively and do not unilaterally amend accepted contracts.

3. Product information, enquiries and order acceptance

Images may be illustrative unless a specific photographed item is expressly identified as the item purchased. Natural variations in living plants, foliage, hardscape and planting arrangements are expected, but material differences from an agreed description are not excused. Enquiries do not reserve stock or production capacity. We confirm availability, specifications, prices, charges and estimated dates before accepting an order. A contract is formed when we confirm acceptance in writing. If we cannot accept an advance payment, we will promptly advise the customer and return the amount due.

Michaela Dawn Visser trading as The Bottled Garden.

References to “customer”, “consumer”, “you” or “your” mean the person purchasing, ordering, enquiring about or receiving goods or services from us.

4. Pricing, payment and records

Prices are stated in South African rand. Delivery charges, compulsory fees, optional extras, and any applicable taxes are disclosed before purchase. Deposits are part-payments and are not automatically non-refundable. Payment deadlines and quotation validity appear in the applicable confirmation. Customers must use payment details on a verified invoice or checkout and independently confirm unexpected changes using our established contact number. We provide a written transaction record and acknowledge accepted orders. No customer is required to accept credit in place of a legally due refund.

5. Availability and substitutions

If an accepted product, plant, vessel or service becomes unavailable, we will notify the customer promptly. We may offer a reasonably comparable alternative, revised date or refund as applicable; material substitutions require the customer’s agreement. We will not impose store credit or a materially different product without consent. Statutory remedies remain available.

6. Custom terrarium commissions

Commissions begin with consultation and a written proposal describing the agreed vessel, approximate dimensions, design direction, materials, price, payment milestones and estimated delivery. Work begins after written acceptance and the stated deposit. Designs may use natural components whose appearance varies. Material design changes require agreement, including any revised price or lead time. A customer-requested cancellation may attract a reasonable, evidenced charge for committed costs and work performed, subject to applicable law; blanket forfeiture is not automatic. Customised goods may fall within ECTA cooling-off exceptions, but statutory rights for defective or misdescribed goods remain.

7. Dispatch, shipping and local delivery

Available delivery methods, destinations, rates and lead times are confirmed before payment. Courier transit estimates are not guaranteed arrival dates unless explicitly agreed in writing. We dispatch live goods when reasonably safe and appropriate, taking account of weekends, heat, weather and carrier limitations, and notify customers of material changes. Risk of loss or damage remains with us until delivery to the customer or an authorised recipient as required by applicable law, including where our arranged carrier is used. Any exception involving a carrier independently selected by the customer must be assessed under applicable law. We remain responsible for failure to perform within the agreed period and for legally required remedies.

8. Collection, lockers and missed deliveries

Collections are by appointment. Customers should promptly collect perishable or living goods once notified they are ready. For lockers and pickup points, collection timeframes and carrier rules will be disclosed; delays outside the customer’s reasonable control will be considered fairly. Where an agreed delivery attempt fails because no authorised recipient is available, reasonable additional delivery or storage charges may apply only if disclosed and lawful. Customers may inspect goods on collection without waiving statutory rights.

9. Live Plant DOA and Arrival Guarantee

We offer an additional 24-hour Dead on Arrival (DOA) and Arrival Guarantee for eligible live plants and planted products, covering material death, severe transit-related deterioration, material transport damage, incorrect supply or material discrepancy apparent on arrival. Notify us within 24 hours after actual delivery or collection, ideally with the order reference, photographs of the full item, close-up of the concern, packaging and a brief description. For lockers, the voluntary notification window ordinarily starts when the parcel is actually collected. Keep relevant packaging and avoid unnecessary alterations while the issue is assessed. We may request reasonable additional evidence. Where a valid claim under this voluntary guarantee is established, we will propose an appropriate replacement, refund or other agreed remedy, subject to stock and applicable law. Minor normal transit responses, such as slight leaf repositioning or temporary wilting, are assessed contextually and do not automatically establish a defect. This 24-hour notification requirement applies ONLY to our additional arrival guarantee and never limits statutory rights, including the CPA implied warranty where applicable. We will consider later statutory claims on their merits.

10. Product quality, care and statutory warranty

We supply products that meet applicable standards of quality, safety, description and suitability. The CPA generally provides qualifying consumers with a six-month implied warranty for goods that fail to meet section 55 standards, with remedies under section 56. A living plant’s ordinary growth, seasonal change or deterioration caused solely by subsequent unsuitable care is not automatically a supply defect; each case is assessed on evidence and law. Care guidance is provided to support successful ownership but does not replace statutory warranties. Where we supply a defective or incorrect item, customers may contact us for lawful repair, replacement or refund remedies as applicable.

11. Returns, cancellations and refunds for goods

Customers should contact us with their order reference and the issue. Returns for defects, incorrect supply, misdescription, statutory cooling-off or other legal grounds will be handled in accordance with applicable legislation, including applicable delivery/return cost obligations. For discretionary change-of-mind returns outside statutory rights, we may agree return conditions in writing before the transaction; live plants and customised goods may be unsuitable for discretionary return. Where ECTA section 44 applies, its seven-day cooling-off right and refund rules are preserved; section 42 contains transaction-specific exceptions. No policy statement of “no refunds” overrides the law.

12. Workshops: booking and payment

A workshop listing must disclose the organiser, venue, date, start/end time, price, inclusions, vessel information, suitability, capacity, payment schedule and material participation conditions. A provisional hold does not confirm a seat. A booking is confirmed only when we acknowledge receipt of the required deposit and accept the booking in writing. Deposits form part of the ticket price. A 24-hour provisional hold may expire if payment is not received. The booking-specific schedule controls the amount and deadline. We will confirm any dietary request process and accessibility limitations before attendance where relevant.

13. Workshops: customer cancellation and transfers

Customers may request cancellation or transfer in writing as early as possible. Where the CPA permits a reasonable cancellation charge for a reserved service, any charge will take account of notice given, the nature of the booking, actual or reasonably anticipated costs, ability to refill the place and other relevant circumstances. We will not automatically forfeit the entire deposit. A substitute attendee may be accepted if notified in time and if any safety, age and dietary requirements can be met. Statutory rights, including where cancellation is due to death or hospitalisation of the person for whom the reservation was made, remain unaffected. Any specific published cancellation scale requires legal review before adoption.

14. Workshops: organiser cancellation, postponement and changes

If we cancel a workshop, customers may choose a full refund of amounts paid or a transfer to an available replacement event. If we propose a material date, venue or experience change, the customer may reject it and obtain the refund required by law; we will not force a voucher or alternate date. If weather, venue disruption, insufficient attendance or other circumstances prevent safe delivery, we will notify attendees promptly, explain options and comply with applicable refund obligations. Minor non-material changes to facilitators, menu or materials may occur where reasonably necessary, provided the promised experience and agreed inclusions are maintained. Any material substitution requires consent.

15. Workshop participation, food and safety

Workshops involve glass, sharp tools, soil, water and living materials. Participants must follow reasonable facilitator safety instructions and report injuries or hazards promptly. Minors may attend only under the conditions disclosed for the event. Catering may be provided by an independent venue; food choices, allergens and dietary accommodations must be confirmed in advance, and no allergen-free environment is guaranteed unless expressly confirmed. We do not exclude liability for gross negligence, unlawful conduct or any liability that law prohibits us from excluding. Any lawful limitation must be fair, reasonable and brought to attention before contracting.

16. Private and corporate events

Private events require a written quotation specifying minimum/maximum participants, venue responsibilities, catering, travel, staffing, materials, payment milestones, postponement and cancellation arrangements. Dates are reserved only upon written confirmation and payment as specified. Bespoke cancellation charges must be reasonable and legally compliant. The corporate customer must disclose access, safety and venue requirements, and each party’s responsibilities should be recorded.

17. Photography, content and intellectual property

Workshop photographs showing identifiable attendees will be used for marketing only with an appropriate lawful basis and any required consent. Attendees may opt out of promotional photography without losing access to the workshop. Our branding, website content, designs and educational materials remain protected by applicable intellectual property laws. Personal-use photos of a customer’s own creation are welcome; commercial reuse of our materials requires permission.

18. Privacy, WhatsApp and direct marketing

We process contact, order, delivery, payment-confirmation and booking information to fulfil transactions, provide support and comply with legal obligations. Our Privacy Notice must identify purposes, retention principles, recipients, rights and contact details. WhatsApp and other platforms may process information under their own policies. Event participation or purchase does not automatically constitute consent to unrelated marketing. Electronic direct marketing follows POPIA section 69, including consent or the limited existing-customer exception and a free opt-out mechanism. We do not publish customers’ personal information without a lawful basis.

19. Complaints and dispute resolution

Please contact info@thebottledgarden.co.za or +27 72 184 1906 with the order number, explanation and requested remedy. We will acknowledge and investigate complaints reasonably promptly and explain any decision. Customers may exercise applicable rights to approach relevant South African consumer authorities or dispute-resolution bodies. Nothing requires customers to waive statutory rights or pursue private arbitration exclusively.

20. Website, availability and legal terms

We aim to keep listings accurate, but temporary website outages or typographical errors may occur. We will correct material errors and notify affected customers before acceptance or seek agreement after acceptance where legally permitted. South African law governs contracts with our South African company, without restricting mandatory consumer protections. If a provision is unenforceable, the remainder applies to the extent lawful. These terms may be revised for future transactions; the version supplied at acceptance governs existing agreements.

LIVE PLANT DOA & ARRIVAL GUARANTEE

IMPORTANT: PLEASE READ THIS POLICY BEFORE ORDERING LIVE PLANTS

  1. Purpose of the Guarantee

The Bottled Garden’s Live Plant DOA & Arrival Guarantee is an additional commercial guarantee intended to provide customers with a clear process where a live plant arrives dead or suffers material transport related damage.

The guarantee operates in addition to any statutory rights that cannot lawfully be excluded.

  1. DOA

“DOA” means Dead on Arrival.

A plant will generally be considered DOA where, at the time of delivery, its condition clearly indicates that it has died during or before transport and reasonable recovery is not possible.

  1. Arrival Condition Claim

An Arrival Condition claim applies where a plant is not dead but has sustained potentially material damage or deterioration during fulfilment.

Minor normal shipping stress is dealt with separately below.

  1. 24 Hour Reporting Requirement

Any claim under The Bottled Garden’s additional DOA or Arrival Guarantee must be reported within 24 hours of confirmed successful delivery or recorded collection.

The 24 hour period exists because live plant condition can change rapidly after delivery and evidence from the time of receipt is necessary to determine whether damage occurred during fulfilment.

This 24 hour provision governs claims under our additional Arrival Guarantee.

It does not remove any statutory right that South African law does not permit a supplier to exclude.

  1. How to Submit a Claim

Send the claim to:

info@thebottledgarden.co.za

or via the official WhatsApp contact used for the order.

Please include:

  1. your name;
  1. order number or identifying order information;
  1. delivery or collection date;
  1. clear photographs of the parcel as received;
  1. photographs of the external packaging;
  1. photographs of the internal packaging;
  1. a photograph showing the entire affected plant;
  1. close up photographs clearly showing the claimed problem; and
  1. a brief description of the issue.

Where external parcel damage is visible, customers are encouraged to photograph the parcel before fully unpacking it.

  1. Keep the Packaging

Please retain:

  1. the parcel;
  1. packaging materials;
  1. plant;
  1. pot where applicable; and
  1. labels

until we confirm that the assessment is complete.

We may request additional photographs or information where reasonably necessary.

  1. Do Not Materially Alter the Plant Before Assessment

Where reasonably possible, do not immediately:

  1. repot the plant;
  1. divide it;
  1. cut away substantial portions;
  1. apply pesticide or chemical treatment; or
  1. discard the plant

before the claim has been assessed.

Urgent reasonable action to prevent further deterioration is permitted.

If such action is necessary, photograph the condition first wherever possible.

  1. What May Qualify

Subject to assessment, qualifying circumstances may include:

  1. a plant arriving dead;
  1. severe stem or crown damage;
  1. material crushing;
  1. catastrophic root or pot damage;
  1. severe dehydration inconsistent with normal transit stress;
  1. substantial transport damage affecting the viability of the plant;
  1. the wrong plant being supplied; or
  1. another material condition inconsistent with the order.
  1. Normal Transit Stress

Plants are living products and may respond temporarily to darkness, movement and changes in temperature during shipping.

The following will not ordinarily constitute DOA on their own:

  1. mild temporary wilting;
  1. one or a small number of cosmetically damaged leaves;
  1. minor leaf tears;
  1. small superficial marks;
  1. minor bruising;
  1. small amounts of loose substrate;
  1. a bent leaf or petiole that does not materially compromise the plant;
  1. minor yellowing of an older leaf;
  1. lost flowers, buds or flower spikes;
  1. temporary leaf orientation changes; or
  1. ordinary acclimatisation stress.

The severity and effect on the overall plant will always be considered.

  1. Flowers and Blooms

Flowers, buds and flower spikes are naturally more vulnerable to movement during shipping.

The loss or cosmetic deterioration of blooms alone will not ordinarily constitute loss of the entire plant where the underlying plant remains healthy.

  1. Natural Variation

A claim does not arise solely because a living plant differs naturally from a representative photograph in:

  1. leaf count;
  1. growth direction;
  1. exact variegation pattern;
  1. natural colouring;
  1. shape; or
  1. minor size variation.

Where the listing states Actual Plant Shown, material differences will be assessed according to the particular listing and condition of the supplied specimen.

  1. Customer Related Delivery Problems

The additional Arrival Guarantee may be reduced or unavailable to the extent that deterioration was materially caused by:

  1. an incorrect address supplied by the customer;
  1. an incorrect locker or collection point;
  1. refusal or failure to receive a scheduled delivery;
  1. repeated missed delivery attempts;
  1. unreasonable delay in collecting a live plant;
  1. leaving a delivered parcel exposed to extreme environmental conditions;
  1. unreasonable delay in opening the parcel after receipt; or
  1. substantial alteration of the plant after delivery before evidence could reasonably be obtained.

This provision does not exclude rights that may not lawfully be excluded.

  1. Claim Assessment

We will assess claims in good faith and as consistently as reasonably possible.

We may consider:

  1. evidence supplied;
  1. dispatch condition;
  1. packing records;
  1. courier records;
  1. transit duration;
  1. nature of the plant;
  1. degree of damage;
  1. potential for reasonable recovery; and
  1. customer handling after delivery.
  1. Recoverable Plants

A plant experiencing temporary shipping stress may be capable of full or substantial recovery.

Where appropriate, we may first provide reasonable recovery or acclimatisation instructions.

Providing care guidance does not prevent a valid statutory claim where the plant was defective or materially non compliant when supplied.

  1. Approved Claims and Remedies

Where a claim under the additional Arrival Guarantee is approved, the appropriate remedy may include:

  1. replacement;
  1. partial refund where the customer agrees;
  1. full refund;
  1. store credit accepted by the customer; or
  1. another reasonable remedy agreed with the customer.

Where applicable legislation gives the customer the right to choose a statutory remedy, these Terms do not remove that right.

The CPA provides an implied warranty for goods that fail statutory quality requirements and may provide for replacement or refund rights. (SAFLII)

  1. Replacement Availability

A replacement is subject to stock availability.

Where an identical specimen is unavailable, we may propose:

  1. a comparable specimen;
  1. another product of agreed value;
  1. credit; or
  1. refund,

as applicable and subject to the customer’s statutory rights.

  1. Replacement Shipping Cost

Where The Bottled Garden approves a DOA or material Arrival Guarantee claim and replacement is the agreed remedy, we will bear the reasonable cost of the approved replacement delivery method.

If the customer chooses a materially different or more expensive shipping method, the additional cost may be payable by the customer where agreed beforehand.

  1. Original Delivery Charges

Where only one item in a multi item parcel is affected, the original delivery charge is not automatically refundable merely because the transport service was also used successfully for the remaining items.

Where legislation requires delivery costs to be refunded, or the entire transaction is properly cancelled or rejected, those statutory rights prevail.

  1. Fraudulent or Misleading Claims

The Bottled Garden may reject a commercial guarantee claim where evidence is materially falsified, altered or deliberately misleading.

This does not affect the consumer’s right to pursue a legitimate statutory complaint.

RETURNS, REFUNDS & CANCELLATIONS POLICY

  1. General Principle

Returns and cancellations depend on:

  1. the nature of the product;
  1. whether the goods are live or perishable;
  1. whether goods were custom made or specially sourced;
  1. whether fulfilment has begun;
  1. the reason for the return; and
  1. applicable South African consumer legislation.
  1. Statutory Rights

Nothing in this policy removes rights available under the Consumer Protection Act, Electronic Communications and Transactions Act or other applicable South African law.

  1. Live Plants

Live plants are living and potentially rapidly deteriorating goods.

Certain electronic transaction cooling off rights do not apply to goods that by their nature cannot reasonably be returned or are likely to deteriorate or expire rapidly. ECTA expressly contains exclusions of this kind. (Government of South Africa)

Accordingly, a change of mind return of a healthy live plant after delivery may not always be available.

This does not affect rights relating to goods that were defective, materially misrepresented, incorrectly supplied or otherwise non compliant.

  1. Cancellation Before Live Plant Dispatch

If you wish to cancel a live plant order before dispatch, contact us immediately.

Where the order has not yet materially entered fulfilment and no special sourcing or custom work has occurred, cancellation may usually be accommodated.

Any cancellation fee will only be applied where lawful, reasonable and properly disclosed.

  1. Incorrect Items

If we supply an item materially different from the item ordered, please contact us promptly.

Where the error is ours, an appropriate remedy will be arranged in accordance with applicable law.

  1. Defective Goods

Consumers retain applicable statutory rights where goods fail to meet required quality standards.

The additional 24 hour DOA claim procedure does not reduce a non waivable statutory warranty right.

  1. Non LivingStandard Products

For ordinary non perishable goods purchased electronically, applicable ECTA and CPA rights may permit cancellation or return depending on the circumstances.

Where a statutory cooling off right applies, the customer remains responsible for any lawful direct return costs where legislation so provides.

  1. Custom andSpecial OrderGoods

Goods made to customer specifications, clearly personalised goods and certain special order goods may be subject to different cancellation and cooling off rules.

ECTA specifically excludes certain customised or personalised goods from its ordinary cooling off provision. (Government of South Africa)

  1. Cancellation Charges

Where South African law permits a cancellation charge, any charge will be reasonable in relation to the circumstances.

Relevant circumstances may include:

  1. work already completed;
  1. materials purchased;
  1. non recoverable costs;
  1. notice given;
  1. likelihood of resale; and
  1. the particular nature of the order.

The CPA permits reasonable cancellation charges for certain advance bookings and orders and specifies factors relevant to reasonableness. (SAFLII)

  1. Refund Method

Approved monetary refunds will ordinarily be returned using an appropriate payment method.

Processing time may depend on the payment provider or bank.

  1. Store Credit

Store credit will not be forced on a customer where applicable legislation entitles that customer to a monetary refund.

Where store credit is voluntarily accepted, the terms of that credit will be confirmed to the customer.
